Everything about Little Chutney's will remain the same. Breakfast, Lunch and dinner menus and service will not change.

What will now be available is an expanded bar service. This means you can consume liquor and wine without the requirement of ordering a meal.

We are now able to offer the opportunity to cater for functions with drinks and cocktail food.

Should you wish to invite friends for an after dinner/theatre drink or perhaps enjoy after work drinks, it is now possible.

We are focusing on establishing a vibrant atmosphere on Fridays and Saturdays from 10pm to 1am. With ambient DJ music and late night menu for your further enjoyment.

Most importantly you our client can enjoy greater flexibility within Little Chutney's.

 LITTLE CHUTNEY’S – GRANT OF TAVERN LICENCE

On 22nd February 2008 the Director of Liquor Licensing granted an application by Busen Pty Ltd for a Tavern liquor licence for the Little Chutney’s premises on Rokeby Road, Subiaco.

The grant of the liquor licence marks the end of a 4-year journey by Busen Pty Ltd, which also operates Chutney Mary’s Restaurant in the adjacent premises, to obtain a Tavern licence for its premises on the prominent intersection of Rokeby Road and Hay Street.

Busen Pty Ltd first applied to the City of Subiaco in early 2004 for planning approval to change the Chutney Mary’s Restaurant premises from a restaurant to a tavern, in order to allow an expanded operation of the premises. The City refused the application in July 2004.

Busen Pty Ltd appealed from the City’s refusal to the Town Planning Appeal Tribunal, which heard the matter over 3 days in November 2004. In December 2004 the Tribunal allowed the appeal.

One of the principal issues argued in the appeal was the potential for a tavern to have an adverse impact on the amenity of the area, particularly in terms of anti-social behaviour and the social effects of the consumption of alcohol. The Tribunal heard detailed evidence on these matters and also as to the manner in which the premises would operate, and was satisfied that because of the proposed manner of operation the amenity of the area would not be affected.

Another issue argued in the appeal was the availability of carparking bays for patrons of the proposed tavern. The Tribunal found that sufficient carparking bays could be provided by a combination of on-site and off-site bays.

The City of Subiaco appealed against the Tribunal’s decision to the Supreme Court - not against the Tribunal’s findings relating to the amenity of the area but only against the Tribunal’s findings in relation to the provision of carparking.

In October 2005 the Supreme Court upheld the City’s appeal. The Supreme Court found that under the terms of the City’s town planning scheme, the Tribunal was not able to approve the proposed off-site carparking bays, meaning that Busen Pty Ltd was unable to provide the number of carparking bays required for the tavern.

Following the Supreme Court’s decision, Busen Pty Ltd acquired the premises next door to the Chutney Mary’s Restaurant and opened Little Chutney’s as a sister-premises.

In May 2006, Busen Pty Ltd applied to the City again, this time for approval to change the Little Chutney’s premises from a restaurant to a tavern.

Being a smaller premises, carparking was not a problem, but the City still refused the application in July 2006. Notwithstanding the previous Town Planning Appeal Tribunal decision and the smaller premises, the City again relied strongly on the suggested impact of the proposal on the amenity of the area.

Busen Pty Ltd again appealed, this time to the State Administrative Tribunal which had replaced the Town Planning Appeal Tribunal.

The appeal was heard over two days in February 2007 and, after considering the matter for less than two weeks, the Tribunal delivered its decision allowing the application. The Tribunal found that the proposed tavern was well-located and consistent with the City’s overall strategic planning for the Subiaco Town Centre. The Tribunal also found, after again hearing detailed evidence in relation to the amenity of the area and the proposed operation of the premises as a tavern, that it was likely to have an acceptable impact on the amenity of the area.

Following the Tribunal’s decision, Busen Pty Ltd continued to operate Little Chutney’s as a restaurant for a time, to avoid being caught up in the transitional period for the legislative changes proposed by the State Government for applications for liquor licences. Once those changes came into operation, however, Little Chutney’s was one of the first applications to be made for a new liquor licence under the new provisions.
